2. Use License

Permission is granted to temporarily use CareQ for healthcare appointment booking and patient management purposes subject to the following restrictions:

• This is the grant of a license, not a transfer of title
• You may not modify or copy the materials
• You may not use the materials for any commercial purpose without explicit permission
• You may not attempt to reverse engineer any software contained in CareQ
• You may not remove any copyright or other proprietary notations from the materials

3. Service Description

CareQ provides a comprehensive healthcare appointment booking and patient management system designed for healthcare providers in India. The service includes multi-channel booking capabilities (website, WhatsApp, phone), automated patient follow-ups, and administrative tools for healthcare facilities.

4. User Obligations

As a user of CareQ, you agree to:

• Provide accurate and complete information when using the Service
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations, including healthcare privacy laws
• Not use the Service for any unlawful or prohibited purpose
• Not interfere with or disrupt the integrity or performance of the Service

5. Healthcare Provider Responsibilities

Healthcare providers using CareQ are responsible for:

• Ensuring compliance with medical council regulations and healthcare laws in India
• Maintaining proper medical licensure and credentials
• Managing patient appointments and maintaining professional standards of care
• Protecting patient confidentiality and privacy as required by law

6. Payment Terms

For paid subscriptions:

• Payment is required in advance on a monthly or annual basis
• All fees are exclusive of applicable taxes unless otherwise stated
• Fees are non-refundable except as required by law or specified in our Refund Policy
• We reserve the right to change our pricing with 30 days' notice

7. Termination

We may terminate or suspend your access to CareQ immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability

CareQ shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of or inability to use the service. This includes any errors or omissions in any content, or any loss or damage incurred as a result of the use of the service.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of CareQ and its licensors. The Service is protected by copyright, trademark, and other laws of India and foreign countries.

10. Data Protection

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
